TERMS AND CONDITIONS

7X7 SPORTS DEVELOPMENT INTERNATIONAL, INC., trading as 7's Football League and 7's Soccer League in some areas ("7's Football League", "7's Soccer League", "7's", "the league", "the franchise", "we", "us") provides its service on the following Terms and Conditions ("T&Cs"). When a player or club joins any 7's competition through our website 7sfl.com and/or participates in any match organized by the league, the club (and each member player) forms a contract subject to these following terms and conditions with the 7's Soccer League and are committing to for the duration of at least one tournament.

ALL PARTIES ARE REQUESTED TO REVIEW THESE TERMS CAREFULLY, ESPECIALLY IMPORTANT LIMITATIONS ON THE LEAGUE'S LIABILITY FOR PARTICIPATION IN FOOTBALL AND RELATION TO COMMON RISKS ARISING FROM PLAYING FOOTBALL.

BY SIGNING UP YOUR CLUB OR AS A PLAYER AT 7'S, YOU FULLY ACCEPT AND AGREE TO THESE TERMS.

The 7's does not operate on any other terms. These terms do not violate any freedom or right.

  1. LIMITATION OF LIABILITY
a. In its operations, 7's shall provide its services while observing reasonable skill and care to a reasonable standard.
 
b. 7's shall not be liable and excludes itself from the following:
  • Loss of profit
  • Any indirect, special or consequential loss, damage, cost expenses (whether or not resulting from negligence of 7's and its staff) suffered by clubs and/or players which arise out of or in connection with the provision of 7's services.
c. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. In the case of serious personal injury or death, 7's shall be held liable only if such is caused by our negligence.
 
d. Each individual contracting with 7's (club, player or otherwise) under these T&Cs hereby releases, discharges, swears not to sue, and agrees to hold harmless 7's, its officers, employees, agents, workers, any sponsors and advertisers, and owners or operators of premises on which matches take place, from all liability, claims, demands, losses, or damages arising from such party’s negligence or gross negligence.
 
e. All participants will indemnify, save and hold harmless each of 7's, its officers, employees, agents, workers, any sponsors and advertisers, and owners or operators of premises on which matches take place from any litigation expenses, loss, liability, damages or costs any may incur as the result of any claim brought in contravention of the above.
 
f. All participants intend the above terms to effect a complete and unconditional release of 7's from its liability to all match participants and team members to the greatest extent allowed by law and agree that if any clause of these T&Cs becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these T&Cs.

  1. RISKS OF PERSONAL INJURY OR DEATH ARISING FROM A SPORTING ACTIVITY OR EVENT 
a. Playing football (soccer) entails challenges and risks that cannot be fully eliminated. By participating in matches or training for matches related to 7's, you accept and assume the ordinary risks arising from participation in those activities and accept that we shall have no duty to you or to any third party in respect of those risks.  
b. Basic rules:
  • Act responsibly and sensibly as players, coaches, team managers and/or otherwise at all times
  • Do not participate while under the influence of alcohol, non-prescription drugs or illegal substances
  • Follow safety warnings and instructions displayed and/or given to you by a 7's employee or staff
  • Always ask 7's if there is something unclear 
c. 7's recognizes that the league is not in any position to make a medical opinion regarding a player's clearance to participate in matches or games. If unsure, players (and/or coaches and otherwise) should obtain professional and/or specialist advice from a doctor before playing.
d. In the absence of any negligence or other breach of duty by us, participation in football is entirely at your risk.

 

  1. CORONAVIRUS (COVID-19)
a. 7's will operate under approval of relevant government institutions and governing bodies in such a way they are allowed given the coronavirus (COVID-19) situation in respective locations.
 
b. Participants must always follow all relevant COVID-19 healthy and safety protocols and measures provided by, but not limited to, the relevant government institutions and/or agencies, 7's, and its venues.
 
c. By signing up or continuing to take part in 7's games, you are agreeing to these T&Cs and you are declaring you are fit and well and able to participate in football.
 
d. You must make yourself fully aware of the restrictions and guidance given by relevant parties regarding the measures that are in place to safeguard your health.
 
e. Before each match, you will be asked to confirm that you are not displaying any COVID-19 symptoms and that you continue to be fit and healthy. A record of this will be held securely and privately for tracing purposes.
 
f. Any participant must inform the 7's immediately if you test positive for COVID-19. 7's will then follow necessary measures provided by relevant sanctioning bodies.
 
g. By signing up or continuing to take part in 7's games, you are agreeing to your information being shared with the league as necessary for purposes related to the above stated.

  1. TEAMS/CLUBS
a. The teams'/clubs' coaches, managers and/or captains ("Coach", "Manager", Captain", "Team/Club representative) shall be responsible for all participants playing in the team and personally liable to 7's payments.
 
b. Any of the team representatives shall settle payments on behalf of the club prior to the start of a tournament they signed up for. Payments shall be collected on a per tournament segment or season basis.
 
c. The coach, manager and/or captain agrees to this responsibility. The league reserves the right to refuse entry or exclude any participant, team or organization from its competition without giving a reason.
 
d. Exiting a league can only take place at the end of the season.
 
e. The length of a 7's tournament varies from location to location, depending on the number of teams participating. If a team decides to leave during the season, that team will be liable for all the remaining fees of the season as noted in the league's cancellation policy.
 
f. When the first season or segment of a tournament is coming to an end, a team shall be automatically reserved a slot into the next/new season or segment unless the team chooses to opt out, giving a considerable amount of time for notice.
 
g. 7's shall publish its participation rates for its respective tournaments for the benefit of interested clubs prior to the start of a tournament's season or segment.
 
h. For 7's competitions with age caps (U5, U7, U9, U11, U13, U15, U17 and otherwise), managers, coaches and/or captains are responsible in ensuring all players meet the age requirement and/or limit.
 
i. Managers, coaches, and/or captains are also primarily responsible in ensuring all participating players that take part are registered with 7's and therefore understand the rules and Terms & Conditions set by the league.
 
j. Managers, coaches, and/or captains or also primary in-charge of collecting necessary fees on their club's behalf, and assigning roles in connection to the overall seamless management of a team while participating in a 7's-organized event.

  1. FEES / ABSENCES / MATCH TIMES
a. Clubs should accept that in some circumstances, 7's may need to and will change match times (from previously handed out match times). 
 
b. Teams are requested to regularly check the 7's website and social media accounts and reach out to respective location managers/partners and/or tournament commissioners for match-related updates and concerns.
 
c. The match fees are determined by 7's and can be subject to change. Match fees shall be good for one tournament season or segment in whole. Teams shall settle payments before participation in tournaments.
 
d. In the unlikely event payment owed to 7's has not been settled and a tournament is already on-going, the result will be recorded as a 3-0 forfeit against your team. This will be treated as a forfeit without notice and you will still be liable to pay your full charges for the tournament.
 
e. Likewise, no-shows for a fixture would mean an automatic 3-0 win for the opposing side provided they have shown up. Two instances of no-shows shall result in a participating team's season being under review with the league having the right to suspend or eject the team from the current tournament season or segment.

    1. BEHAVIOR AT EVENTS, SPECTATORS, AND RELATED PARTIES
    a. All attendees (players, coaches, spectators, and the like) at any, but not limited to 7's-organized events, press conferences, clinics, and otherwise are expected to behave in a civil and courteous manner to all those present.
     
    b. Any unsportsmanlike or indecent behaviour on or off pitch will not be tolerated.  This includes verbal or physical abuse.  Depending upon the nature of the misbehaviour, further action may be taken in the form of official warnings, suspension or expulsion of players or teams, and ejection of spectators physically from the venue.
     
    c. You accept and acknowledge that 7's, its partners, venues, and the like reserve the right to make such decisions in its sole discretion and shall have no duty to exercise that discretion in a particular manner or according to a particular process.
     
    d. If you have attended a 7's event and feel another attendee has not behaved in accordance with the above, please notify the league immediately as possible.

      1. PLAYER DISCIPLINE
      a. All referees’ decisions are final. Intimidation of referees will not be tolerated and will result in further action being taken by the league, through its commissioners and/or location managers, up to and including expulsion of offending players and teams from the league.
       
      b. 7's reserves the right to ban or expel any player or team from the league or take any other disciplinary action as it deems appropriate.
       
      c. Any team knowingly fielding a suspended player will forfeit any game played 3-0 and will be liable for corresponding sanctions.

        1. HEALTH & SAFETY
        a. No item of jewelry shall be worn.
         
        b. No adornment that may endanger player safety shall be worn.
         
        c. Players must wear suitable clothes and training shoes. Shoelaces must be securely tied before a game. Time allowances will not be given at any point for someone to tie their shoelaces.
         
        d. Shin guards are a requirement in any 7's official match.
         
        e. Participants and/or spectators agree to take full responsibility for any injuries that may occur.
         
        f. All participants play with full knowledge, assumption and acceptance of all risks, losses, costs and damages involved and incurred as a result of their participation. 
         
        g. Participants understand that football is a contact sport, containing an element of risk. 7's does not provide personal injury insurance or player to player insurances. All players play at their own risk and are responsible to take out their personal injury insurance.
         
        h. Participants agree and acknowledge that 7's does not own or have exclusive occupation of venues used and has little or no control in respect of persons entering the premises (including surroundings and other football courts) and no control as to how the premises are used and left before/after competitions. No responsibility can be taken for any loss or damage to personal property.
         
        i. Managers, coaches, and/or captains are fully responsible for assessing the appropriateness of the conditions for their team. If the club feels the environment is not safe to play in, including any misconduct, danger, violence (or threats thereof) or the condition of the premises, then a representative must advise 7's at the earliest opportunity.
         
        j. Smoking, drinking alcohol and anti-social behaviour are forbidden at all premises used by 7's in its tournaments.
         
        k. Football Invasion reserves the right to ban or ask the entire team to leave should they breach any of the above.

          1. PRIVACY POLICY
          a. By participating in 7's events, players and their respective clubs agree that basic information such as, but not limited to their names, playing positions, photos and/or videos may be taken and published online through 7s websites and/or social media channels.
           
          b. 7's shall own rights to these media to be used for promotion. Players, managers, and coaches of clubs agree to waive any moral rights, image and/or video rights, right of publicity or privacy in respect of media representing them in the above.
           
          c. For reasonable circumstances, such as self-incrimination, teams or players must specify when they join the league if they do not want their pictures or any form of media displayed on 7's digital platforms.
           
          d. When signing up as an individual, 7's may help you form a new team which includes you, and you agree to give 7's the right to share your details with other players forming or trying to be formed into a club.
           
          e. The above terms do not affect the participants' rights as data subjects as per an area's laws.

            1. FORCE MAJEURE AND GENERAL REMINDERS
            a. 7's shall not be in breach of its obligations under these T&Cs, or liable for any loss or damage caused by delay in the performance or non-performance of any of its obligations, where the same is occasioned by any cause whatsoever that is beyond its reasonable control (“Force Majeure”) including but not limited to an epidemic, Act of God, war, civil disturbance, un-preventable flood, failure or neglect on the part of any utility supplying electricity, gas or water, the unavailability of or the prevention of access to premises, governmental regulations, prohibitions or enactments of any kind, strike, lock-out or trade dispute (whether involving its own employees or those or any other person), difficulties in obtaining staff or materials, breakdown of machinery, fire or accident or loss of premises.
             
            b. Should an event of Force Majeure occur, the time for 7's performance shall be extended by a period equivalent to the period during which performance has been delayed or occasioned by Force Majeure.  If the period of Force Majeure extends for more than [6 weeks], Football Invasion may terminate the contract comprising these T&Cs immediately by written notice (including by formal notifications).
             
            c.These T&Cs constitute the entire agreement between the parties and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
             
            d. Each party acknowledges that in entering into this agreement it does not rely on, and shall have no remedies in respect of, any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these T&Cs.
             
            e. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these T&Cs
             
            f. Except as expressly provided in these T&Cs , the rights and remedies provided under this agreement are in addition to, and not exclusive of, any rights or remedies provided by law.
             
            g. No failure or delay by a party to exercise any right or remedy provided under these T&C’s or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.
